Toneflow User Service Terms

Applicability Specification: These terms are a global Universal Standardized Service Agreement, applicable to Toneflow users in all countries and regions, conforming to the International Internet Services Code, the Global Commercial General Standards, and the Digital Products Compliance System, without any regional jurisdiction bindings and regional restrictions.

Product Localization: Toneflow is an immersive ASMR and Scene Focus tool for global users, offering purely endpoint offline services such as multi-scene playback, custom audio recording, focused timing, focused logging, and local audio import management, without providing cloud content storage and network distribution services.

1. Acknowledgement of the Agreement and Service Definitions

1.1

These User Services Terms are a fully legal compliance agreement between the user and the product operating entity, fully defining the legal rights, compliance obligations, and liability boundaries for both parties in the course of using all Toneflow features, covering the entire service content of the product‘s existing features and subsequent iterative updates.

1.1.1

By downloading, installing, starting, retaining and continuing to use this App, the User represents that he has fully read, deeply understood, voluntarily accepted and unconditionally abides by all terms and conditions of this Agreement. If the User does not accept any content of this Agreement, he must immediately terminate all usage activities and completely uninstall this App.

2. Service Authorization and Use Permissions

2.1

Operators grant users limited, non-exclusive, non-transferable, unilaterally revocable, personal, non-commercial use, and users can only use in compliance the core functions of this app, such as sound-scene preview, focus timing, audio recording, local audio import, focus log viewing, and more, on personal, private terminal devices.

2.1.1

Users are strictly prohibited from implementing decompilation, reverse parsing, code tampering, secondary development, program duplication, feature theft, and other technical operations on this application, and are prohibited from using the application body, built-in sound-scene resources, recording functions, and timing components for commercial monetization, paid services, public transmission, third-party embedding, and other non-personal compliance scenarios.

3. User Compliance Use Guidelines

3.1

Users pledge to strictly comply with local digital content standards, intellectual property protection regulations, and international web protocols throughout their use of Toneflow, and to use immersive sound scenes, ASMR audio recording, and focused management tools services in a legal and compliant manner.

3.1.1

Users are not allowed to use this App to record, store, play back, or retain infringing piracy, obscene pornography, violent violations, and audio content that violates public order and good manners, nor to use the product‘s features to produce infringing sound and scene materials. Users are fully and independently liable for all legal liability, dispute losses, and compliance risks arising from any infringing operations.

4. Global Intellectual Property Protection Standards

4.1

All of Toneflow‘s program source code, sound-scene classification system, audio decoding algorithms, timing interaction logic, interface visual design, brand identification, recording processing architecture, and other core intellectual property rights are exclusively owned by the operators and are fully protected by global intellectual property agreements and international digital product compliance systems.

4.1.1

No individual or organization is permitted to copy, steal, alter, reproduce, disseminate, or commercialize the core resources and built-in sound and video materials of this product without the official written authorization of the Operator. The Operator reserves all rights to terminate services, pursue liability, and defend its legitimate interests in the event of any infringement.

5. Mechanism for Functional Iteration and Protocol Updates

5.1

Operators reserve the right to adjust, add, streamline, and optimize product features and service forms at any time based on requirements such as technology upgrades, immersive experience optimization, global compliance iterations, and feature scenario expansion, to continuously adapt to various use scenarios such as meditation, learning, work, and relaxation for global users.

5.1.1

The amendments to these Terms of Service will be made known and take effect immediately upon update through the Applicable Official Publication Channel. Users‘ continued login and use of any feature of the product is to be regarded as automatically acknowledging and accepting the full content of the latest version of the Agreement, without objection and voluntarily complying with it.

6. Service Stability and Exception Disclaimer

6.1

Toneflow is a purely localized offline tool with core soundscene playback, audio recording, and focused timing functions that do not require network empowerment. Operators iteratively optimize product stability, device compatibility, and operational smoothness over a long period of time, dedicated to providing users with a stable and immersive experience.

6.1.1

Operators are not liable for any loss compensation due to external objective factors such as iteration of device system versions, software and hardware conflicts, changes in system permissions, device hardware failure, user private modification of terminal configuration, etc.

7. Termination of Service and Authority Control Rules

7.1

Operators have the right to unilaterally terminate all user rights immediately, without prior notice, for users who engage in illegal activities such as maliciously tampering with applications, illegal commercial use, abuse of recording and sound-scene functions, production and dissemination of illegal audio, infringement of platform intellectual property rights, and interference with the proper operation of products.

7.1.1

Upon termination of service rights, users must immediately stop all product usage behaviors. Operators are not obligated to back up, restore, preserve custom audio recordings in devices, locally import audio, focused logging, etc. all local data for users, and the associated data risks are at the user‘s own risk.

8. Third-party Services and External Constraints Specifications

8.1

Toneflow maintains purity without embedded product ecosystems, does not integrate any third-party advertising SDKs, data analysis tools, content push components, external jump links, and paid value-added services, and only invokes device-native microphones and file system to implement basic functionality.

8.1.1

The authorization calls and data interaction behaviors that arise between the user and the device‘s native operating system are all subject to the constraints of the corresponding system’s official service agreement. Operators do not participate in, interfere with, or assume any third-party associated risks and responsibilities.

9. Disclaimer and Risk Ownership Principle

9.1

Toneflow provides technical services only as a neutral immersive soundscape and focus tool, does not produce, review, or control user-recorded, imported, or retained local audio content, and assumes no responsibility for the legality, integrity, or compliance of user personal materials.

9.1.1

Users bear full responsibility for the loss of data and content risks caused by their own actions, such as accidentally deleting audio, clearing logs, device damage, improperly tampering with applications, and actively authorizing third parties to read local materials.

10. Dispute Negotiation and Post-Sales Consultation Mechanism

10.1

All controversies, disputes and compliance issues arising from this product and service are prioritized by both parties to be properly addressed using an international Universal Friendly Negotiation Model. Users can submit inquiries, complaints, suggestions and problem feedback through the official dedicated email atanaskovic@vila-grad.com.

10.1.1

Controversial issues that cannot be negotiated to reach consensus will be dealt with according to the International General Business Fair Principles and the Global Digital Product Compliance Code, with no regional bias and special jurisdiction bias, and equal protection of the legitimate rights and interests of both parties in the agreement.
